Testimony concluded this afternoon in the trial of two men charged with assault and criminal sexual conduct for a panty-cutting incident more than a year ago at a Sartell bar.
Attorneys next week will submit written closing arguments to Stearns County District Court Judge Vicki Landwehr, who has seven days from receiving the arguments to issue a verdict.
Michael Puhalla and Russell Baumgardner are charged with second- and fifth-degree criminal sexual conduct and second-degree assault. Both men are free pending the trial outcome.
Puhalla is accused of holding the arms of the female acquaintance while Baumgardner slit the waistband of her panties and tried to pull them out of the woman’s jeans. Both men face identical charges of aiding and abetting assault and criminal sexual conduct.
The men told police that they had done the same thing to other acquaintances previously, and that they thought the whole incident at the Dam Bar in December 2007 was a joke among friends. They also told police they thought the female considered their actions a joke and that they were surprised when she later reported it as a crime.
The woman told police that she considered the incident a joke when she was bantering with Puhalla and Baumgardner about them wanting to cut her panties. But the joke ended, she testified, when they held her arms and used a folding knife to cut her panties as she told them to stop.

Definitely nuts, or mutual play without a safe word to say, "It's gone too far stop!". Either way they deserve some jail time, if for nothing else mutilating the panties!!!
